Tony Fama's practice focuses on technology and intellectual property law issues, including technology transactions, the registration and commercialization of trademarks and copyrights, data privacy and security, Internet and e-Commerce law, and the creation or revision of contract templates and policies. Tony represents a broad range of clients, from large public companies to start-ups, in a variety of industries, including software, IT services, e-commerce, and manufacturing. He assists these clients with in a variety of tasks, including: 

• Structuring, drafting, negotiating, and closing technology-related and other strategic transactions, such as software licensing, hardware procurement, professional services, distribution agreements, outsourcing, and asset acquisition agreements;
• Compliance with data privacy and security laws, including HIPAA;
• Drafting or improving form contracts and contracting processes;
• Protection of intellectual property assets, including the federal registration of trademarks and copyrights; and
• Drafting web site terms of use and privacy policies. 

Tony is regularly lead counsel in negotiations for clients with industry powerhouses like Microsoft, Cisco, Verizon, AT&T, IBM, SAP, HP, and Oracle. His consistent success in these efforts has led to referrals from both clients and even opposing counsel.

Since graduating from Harvard Law School with honors in June 1992, his legal career has included senior-level experience at Fortune 500 companies, including Gateway, Siebel Systems, and IBM, as well as large law firms. Immediately before joining David, Brody & Dondershine, Tony ran a successful solo practice for seven years.

Honors and Awards

  • While at Siebel Systems, Tony was voted the 2005 Americas Legal MVP by executive management and the Americas sales team, in part for his efforts in helping close sales transactions as well as leading a cross-functional team responsible for compliance with domestic and foreign privacy laws, including a complete revision of the company's privacy policy and achieving EU/US Safe Harbor certification.
  • While at CIA, Tony received two Certificates of Exceptional Accomplishment from the Director of Central Intelligence
